Simple land consolidation

Simple land consolidation does not deal with an entire cadastral district, but with a specific problem or with a defined part of the district – access to land parcels, clarification of ownership relations, separating off part of an area or a single measure needed in the landscape. The scope of the work depends on the assignment. It is used where comprehensive land consolidation is not needed or where there is no time for it: the procedure involves a smaller number of owners and can prepare the ground for comprehensive land consolidation later on.

What it is for

A tool for a specific problem

Simple land consolidation is not a shortened version of the comprehensive procedure. It addresses a selected economic or ecological need – and that need determines what has to be prepared.

Simple land consolidation is governed by the same Act No. 139/2002 Coll. as the comprehensive procedure, but it does not treat the area as a whole. It is carried out where only some economic needs have to be resolved – for example the expedited merging of land parcels or access to them – or ecological needs in the landscape, typically a local erosion control or flood protection measure. The same form is also used when the land consolidation is to cover only part of a cadastral district.

There need not be any exchange of ownership rights at all: even without it, simple land consolidation can be used to site and implement a common facility. Areas where the allotment records are incomplete, damaged, illegible or have not survived are then dealt with in the form of a refinement or reconstruction of allotments.

Here too the contract is usually awarded by a branch office of the State Land Office (Státní pozemkový úřad). A municipality or the owners can file a request – we can help both with preparing it and with assessing whether simple land consolidation is the right course of action.

How the scope is determined

What is prepared and what is not

Of the stages that comprehensive land consolidation always goes through, only some apply to the simple procedure. We say which ones at the outset.

The perimeter is defined and surveyed here as well – without a delimited and surveyed boundary there is nothing to work with. The schedule of claims and the proposal for the new layout are prepared only where ownership rights actually change.

The plan of common facilities (field roads, water management and landscape measures) is not a mandatory part of simple land consolidation; only the measure that is the subject of the assignment is designed. That makes it all the more important for it to fit into the wider context – runoff conditions, erosion risk and any future comprehensive land consolidation.

The assessment also includes the opposite answer: if comprehensive land consolidation would bring more benefit in the given situation, we will say so.

What you ask us most.

Comprehensive land consolidation deals with an entire cadastral district or a substantial part of it, and the plan of common facilities is a mandatory part of it. Simple land consolidation is carried out only for a defined part of an area or for a selected economic or ecological need, and its scope depends on the assignment; the plan of common facilities may be dispensed with.

It does not. Simple land consolidation can be used to site and implement a common facility even without an exchange of ownership rights. The refinement or reconstruction of allotments also usually manages without a change of ownership.

A request can be filed with the branch office of the State Land Office, which decides whether to open the procedure. We will help both with preparing the request and with assessing whether simple land consolidation is suitable.
